Terms of service

These terms are the agreement between you and SkyPorch LLC, a Florida limited liability company ("we", "us"), for using Daykeeper, including the app, website, support chat widget, API, SDKs and agent tools. By creating a workspace or using Daykeeper, you agree to them. If you use Daykeeper for a company, you agree for that company.
Your account
- You must be at least 18 and give us accurate details.
- You're responsible for your workspace, everyone you invite, and anything done with your API keys or agent credentials. Keep them safe and tell us right away if one leaks.
- One person or company per workspace owner. Don't share sign-ins.
Plans, billing and cancelling
- Plans and prices are on our pricing page (mydaykeeper.com/pricing). Paid plans are priced per workspace and billed monthly in advance through Stripe.
- Paid plans renew automatically until you cancel. You can cancel at any time in your billing settings, and your plan stays active until the end of the period you've paid for.
- Prices don't include taxes unless we say so. You pay any taxes that apply.
- If we change a price, we'll tell you at least 30 days before it applies to you.
- Overage is off by default. It only turns on if a verified workspace owner turns it on and sets a monthly budget.
- Payments aren't refundable, except where the law requires a refund. If something went wrong with a charge, email support@mydaykeeper.com and we'll look at it.
Your content
You own your Customer Content: the messages and contact details your customers send through Daykeeper. You give us permission to host, process and send it only to run Daykeeper for you, as our Privacy Policy describes.
You're responsible for having the right to collect that data, for telling your own customers how you use it (usually in your own privacy policy), and for following the laws that apply to your business, including email and marketing laws.
Acceptable use
Don't use Daykeeper to:
- Break the law or help someone else break it.
- Send spam or messages to people who didn't contact you or ask to hear from you.
- Harass, threaten or deceive anyone, or send malware or phishing.
- Get around usage limits, overload our systems, or test their security without our written permission.
- Copy, resell or reverse engineer Daykeeper, except where the law allows it.
AI features, agents and the API
AI output can be wrong or incomplete. Check it before you send it to a customer. You're responsible for what you send.
If you connect an AI agent, script or other tool to Daykeeper, you're responsible for what it does with the access you give it. Use the smallest permissions it needs.
SaaS Health Check estimates
The SaaS Health Check reviews costs and usage information you provide or make available through authorized billing pages. It can compare current published prices and estimate the margin of an AI feature from supplied figures. Results depend on the evidence and assumptions available, may be incomplete or wrong, and are not financial advice or a promise of savings. Review recommendations before acting. The Health Check cannot change vendor accounts, purchase or cancel plans, connect to banks, or save a report.
Revenue Leak Finder scenarios and reports
Revenue Leak Finder provides arithmetic estimates and scenarios based on the period, evidence, currency and assumptions shown in each report. It does not provide financial, tax or legal advice, guarantee recovery or revenue improvement, or predict future results. Its Stripe health check reports invoice balance at risk only for invoices and dates covered by the retrieved evidence; partial coverage may omit invoices. Revenue Leak Finder cannot change prices or Stripe settings, retry payments, issue refunds, send recovery emails, or save report history. CSV analysis runs in your browser, and only aggregate CSV results are sent to ChatGPT when you choose Share summary.
Other services
Daykeeper works with services we don't control, such as Stripe, your email provider and your AI tools. Their own terms apply to how you use them.
Our product and your feedback
Daykeeper, our code and our brand belong to us. These terms don't give you any rights to them beyond using Daykeeper. If you send us ideas or feedback, we can use them without owing you anything.
Changes and availability
We work hard to keep Daykeeper running, but we don't promise it will always be available or free of errors. We may add, change or remove features. If we remove something you pay for, we'll tell you first.
Suspension and closing your workspace
You can close your workspace at any time. We may suspend or close a workspace that breaks these terms, puts others at risk, or doesn't pay. Where we can, we'll warn you first and give you a chance to export your data. After a workspace closes, we delete its data as our Privacy Policy describes.
Disclaimers
Daykeeper is provided "as is" and "as available". To the extent the law allows, we disclaim all implied warranties, including merchantability, fitness for a particular purpose and non-infringement.
Limit of liability
To the extent the law allows, we aren't liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data. Our total liability for any claim about Daykeeper is limited to the greater of the amount you paid us in the 12 months before the claim, or $100.
Indemnity
If someone makes a claim against us because of your content, your use of Daykeeper or your breach of these terms, you'll cover our reasonable costs and losses from that claim.
Governing law
These terms are governed by the laws of the State of Florida, without regard to its conflict of law rules. Any dispute goes to the state or federal courts located in Florida, and both of us agree to those courts.
Changes to these terms
When we change these terms, we'll update the date at the top. If a change matters, we'll email workspace owners at least 14 days before it takes effect. If you keep using Daykeeper after that, the new terms apply.
